1. About us
Yuandusite.com is operated under the Borvan brand by 元渡贸易(深圳)有限公司 (provisional English translation: Yuandu Trading (Shenzhen) Co., Ltd.), Room 702, No. 87 Fanshen Road, Anle Community, Xin'an Subdistrict, Bao'an District, Shenzhen, Guangdong, China. Email: yuandusz@outlook.com. Telephone: +86 175 0335 7373.
2. Scope and consumer rights
These Terms apply to purchases from yuandusite.com. If you are a consumer, nothing in these Terms excludes or restricts rights that cannot lawfully be waived, including mandatory rights in the country where you habitually reside.
3. Eligibility and account security
You must have legal capacity to enter into the purchase. You are responsible for accurate information and for keeping account credentials confidential. Notify us promptly of suspected unauthorised use.
4. Product information and compatibility
We take reasonable care to describe products accurately. Images may vary slightly because of screens, lighting, manufacturing revisions or packaging changes. Before ordering 3C electronics, check disclosed voltage, plug, network bands, operating-system, device and regional compatibility. This does not limit remedies where information was inaccurate or goods do not conform to the contract.
5. Order process and contract formation
Products in the store are invitations to place an order. Your order is an offer to purchase. We acknowledge receipt electronically, but acceptance occurs when we send an express acceptance or dispatch confirmation. If we cannot accept an order, we will notify you and refund amounts collected. Please save the confirmation and these Terms.
6. Prices, tax and customs
The checkout displays the product price, currency, applicable tax and delivery charge known to us before you submit the order. Where import duties, customs charges or taxes are not collected at checkout, they may be charged by local authorities or carriers; we will disclose this before purchase where applicable. We may correct an obvious pricing error before acceptance and will give you the option to confirm at the correct price or cancel.
7. Payment
Payment may be processed by PayPal or FuturePay, subject to the selected provider's terms and privacy practices. You authorise the applicable charge when submitting the order. We may use lawful fraud-prevention checks and may decline or cancel a transaction where reasonably necessary.
8. Delivery
Orders may be delivered through YunExpress and local delivery partners. Available methods, charges and estimated dates are shown at checkout or in the order confirmation. Estimates are not guarantees unless expressly stated. We remain responsible for delivery as required by applicable consumer law. Please contact us promptly about material delay, loss or damage.
9. Ownership and risk
Risk passes to an EU consumer when the consumer, or a nominated third party other than the carrier, physically receives the goods, except where the consumer independently commissioned a carrier not offered by us. Ownership passes when full payment is received, subject to mandatory law.
10. Withdrawal, returns and refunds
Our Returns & Refunds Policy forms part of these Terms. Eligible EU/EEA consumers generally have 14 days after receipt to withdraw from a distance purchase, subject to statutory exceptions. A Model Withdrawal Form is available on the website.
11. Legal guarantee
Goods must conform to the contract. EU consumers receive the mandatory legal guarantee and remedies provided by applicable law. Any commercial warranty is additional and does not replace statutory rights.
12. Acceptable use and intellectual property
You may use the website for lawful personal shopping. You must not interfere with security or operation, scrape the website unlawfully, submit malicious code, impersonate others or use content in violation of intellectual-property rights. Website content is owned by us or our licensors and may not be commercially reproduced without permission, except as permitted by law.
13. Liability
Nothing excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory product and consumer liability. Subject to that rule, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer. These limitations apply only to the extent permitted by applicable law.
14. Privacy
Our Privacy Policy and Cookie Policy explain how we process personal data and use cookies.
15. Events beyond reasonable control
We are not responsible for delay caused by events genuinely beyond our reasonable control, but we will take reasonable steps to reduce the impact and will respect cancellation or refund rights required by law.
16. Changes
The Terms applying to an order are those made available when the order was placed. We may update these Terms for future orders. Material changes will not retroactively reduce existing contractual rights.
17. Governing law and disputes
These Terms and the contract are governed by the laws of the People's Republic of China, without depriving an EU/EEA consumer of mandatory protections available under the law of the country where the consumer habitually resides. Courts available under mandatory consumer law retain jurisdiction. Before starting formal proceedings, please contact us so we can try to resolve the matter. If you are protected by additional mandatory Mexican or other national law, those non-waivable rights remain unaffected.
18. General
If a provision is invalid or unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver. We may transfer the contract only where this does not reduce your rights; you may transfer your rights where law permits.
